How we collect and use personal data — both when we contact businesses and when you get in touch with us.

This notice explains how Fearless Funding (“we”, “us”, “our”) collects and uses personal data. It covers two situations: information we use to contact businesses about commercial finance (which we obtain from public sources and third parties), and information you give us directly when you get in touch — for example through the enquiry form on this website.

01 The information we hold and where it comes from

If we contact you about finance

We process a limited set of business-context information about people in their professional capacity:

  • Name and job title or role
  • Business email address and, where available, business phone number
  • The company you are associated with and publicly filed information about it, including financial information filed at Companies House

We obtain this from the public register maintained by Companies House, from reputable business-data enrichment providers, and from other publicly available business sources such as company websites. Because this information comes from those sources rather than from you directly, this notice is how we meet our transparency duty under Article 14 of the UK GDPR — normally no later than our first contact with you.

If you contact us through this site

When you submit our enquiry form, you provide us directly with your name, business name, email address, phone number, what you need funding for, the amount required, and a short summary of your situation. We only hold this because you choose to send it, and we treat enquiries in confidence.

We do not seek or process special category data (such as health, race or political opinions), and we do not knowingly process the personal data of consumers or children. Please don’t include sensitive personal details in the free-text part of the form.

02 How and why we use it, and our lawful basis

Outreach to businesses

We use the information above to identify businesses that may benefit from commercial finance and to contact the relevant decision-maker to introduce our brokerage service. Our lawful basis is legitimate interests (Article 6(1)(f) UK GDPR) — promoting our services to businesses likely to need them. We have carried out and documented a legitimate interests assessment confirming this is fair and proportionate; you can ask us for a summary using the contact details above.

Responding to your enquiry

Where you contact us, we use your details to reply, to discuss whether we can help, and to take steps at your request before potentially entering into an arrangement. Our lawful basis is taking steps at your request prior to a contract (Article 6(1)(b)) and our legitimate interest in responding to enquiries.

03 Who we share it with

We use trusted service providers that act on our instructions under contract and only process the data for us:

  • findymail — to find and verify business contact details.
  • Instantly — to send and manage our outreach emails.
  • Web3Forms — to receive enquiry-form submissions and deliver them to us.
  • Google Workspace (email) and Netlify (website hosting) — to receive enquiries and serve this site.
  • The party that builds and operates our lead-generation pipeline on our behalf.

We do not sell your personal data. We may disclose it where required by law.

04 Cookies and analytics

Our website does not use tracking or advertising cookies, and it does not load analytics. Fonts and scripts are served from our own website rather than a third-party content network, so simply viewing a page does not share your details with an outside provider. When you submit the enquiry form, the form-handling service we use (Web3Forms) receives the information you send, together with limited technical data such as your IP address, only to deliver your enquiry to us. You can control or block cookies at any time through your browser settings. If we ever introduce non-essential cookies, such as analytics, we will ask for your consent first.

05 International transfers

Some of our service providers are based outside the UK. Where your data is transferred outside the UK, we rely on appropriate safeguards so that it remains protected: for transfers to the European Economic Area we rely on the UK’s adequacy regulations, and for transfers to other countries (such as the United States) we rely on the International Data Transfer Agreement, the UK Addendum to the EU Standard Contractual Clauses, or the UK extension to the EU–US Data Privacy Framework where the provider is certified.

06 How long we keep it

Outreach data. We keep this only as long as needed for the purpose above. If you do not respond, or you opt out, we delete or anonymise your details within 12 months of our last contact, except for a minimal suppression record so we do not contact you again.

Enquiries. We keep the details you send us for as long as needed to deal with your enquiry and any relationship that follows, and in any event no longer than 24 months after our last contact about it. Web3Forms retains submissions in its system for a short period (around 30 days) before they are removed.

07 Automated decisions

We do not make decisions about you that produce legal or similarly significant effects based solely on automated processing. We use automated filtering to identify businesses that may have a finance need, but any contact, and any decision, always involves a person.

08 Your rights

You have the right to:

  • Object to our use of your data for direct marketing — this is an absolute right, and we will stop immediately on request
  • Ask for a copy of the personal data we hold about you
  • Ask us to correct inaccurate data or complete incomplete data
  • Ask us to erase your data or restrict how we use it
  • Object to processing based on legitimate interests, on grounds relating to your particular situation
  • Ask us to transfer the data you gave us, where that’s technically possible

To exercise any right, email us at mark@mdcresources.co.uk. To stop receiving emails, you can also use the unsubscribe link in any message. There is no charge, and we will respond within one month.

09 Complaints

If you are unhappy with how we have handled your data, please contact us first at mark@mdcresources.co.uk so we can put it right — we will acknowledge your complaint within 30 days. You also have the right to complain to the Information Commissioner’s Office (ICO) at ico.org.uk or on 0303 123 1113.

We may update this notice from time to time. The current version and its date are shown at the top of this page.
